A strict code of ethics is followed during Competitive Intelligence gathering. No illegal means are used. [Argument: If an ethical hacker is doing any part of the ethical hacking process then it is assumed he/she already has a pentest agreement in place which MAY allow for the hacking of a personal account. Just food for thought] [Counter-argument: The argument you put forth is incorrect unless the company you have a pen-test agreement with is also the service provider for the said user's private accounts. For example: if you are pentesting Company A and you discover one of their employees has a Gmail account. If you attempt to breach this account you are now executing an attack against Google, with whom you do not have a testing agreement with. Therefore, you would be committing an offense under USC 1029 and/or 1030. The only possible exception to this might be if you acquired a user's password from Company A's systems and the user uses the exact same password for Gmail and you attempted to log into their account through password guessing. This would, however, still be a violation of Google's Terms of Service and Acceptable Use Policy and probably still be constituted as unauthorized access to a user's account since, in as far a how I understand it, Google's AUP and ToS outline that only the named account owner should have non-delegated access to their account and any for other user to access an account that they are not the creator/owner of, is a violation. Tl;dr: Even if your target company has signed a pen testing agreement, Google, Microsoft, Yahoo, and other personal e-mail service provides have not.]
